Your Guide to Regulatory Waste

Regulatory Resources

WiQ does the research for you! Our Waste Wizards understand the regulatory bodies that govern the various industries with each province and have brought to life the legislative requirements right into the application. These valuable resources can assist in navigating regulatory requirements for waste characterization/classification and transportation.

See below a breakdown of the associations, federal, and provincial regulations that impact the energy industry.
Associations
Canadian Association of Petroleum Producers
The Canadian Association of Petroleum Producers (CAPP) is an industry association representing Canada's upstream oil and natural gas producers. CAPP plays a crucial role in advocating for sound policies, promoting responsible development, and fostering innovation within the petroleum industry. As part of their commitment to environmental stewardship, CAPP has developed the CAPP Waste Profile Sheets, which serve as a standardized resource for managing wastes generated by the industry.  The waste profile sheets can be found  under the research and publications page or by searching for the Oilfield Waste Profile Sheets Guide.

The CAPP Waste Profile Sheets are essential tools for assisting waste generators with the classification and handling of commonly produced oilfield wastes. The Waste Profile Sheets are designed to comply with TDG regulations and AER guidelines and provide information to support environmental stewardship by promoting safe and responsible waste handling practices. The Sheets are broken down into four general sections: General Information, Hazard Information, Management Methods, and Transportation.

The Waste Profile Sheets are an excellent starting point for generators to use for waste classification as they provide generators with general industry guidance on a variety of different waste streams, but they are not a substitute for robust classifications programs and should be used as a supplemental resource and not as a replacement for proper characterization and classification.
Federal Regulations
Transportation of Dangerous Goods
Transport Canada through the Transportation of Dangerous Goods (TDG) Act and Regulations details the requirements for industry waste haulers that transport dangerous goods within Canada. TDG promotes public safety during the handling, transportation, and receipt of dangerous goods by road, rail, air, or water. Many industrial and oilfield wastes fall into the category of hazardous material and must therefore ensure compliance with TDG regulations.

The industrial and oilfield waste classification built into WiQ follows Schedule 1 of TDG Regulations - which defines the UN Number, Class Packing Group, Special Provisions, and more for each dangerous good as assigned by the United Nations Committee of Experts on the Transportation of Dangerous Goods and Transport Canada.

It is essential to have the necessary documentation in place. Using WiQ ensures that you generate the correct documentation before transporting the hazardous material. This document includes the TDG shipping document, which provides detailed information about the hazardous materials being transported. The shipping document must include the proper shipping name, UN Number, hazard class, packing group, and quantity of the hazardous materials being transporter. For more information on the Shipping Document and the roles and responsibilities of all parties involved, see Part 3 of the TDG Regulations.

TDG Regulations require that individuals involved in the transportation of hazardous material, including those using WiQ, undergo and maintain appropriate training. This training ensures that everyone involved understands the specific requirements and procedures to the hazardous material safely. It is essential to keep records of this training to demonstrate compliance with the TDG Regulations. The government of Canada keeps an active directory of organizations providing dangerous goods training which you can use to locate an accredited training centre.

Failing to comply with these regulations not only poses significant risk to the environment and public safety, but also carries severe legal consequences. WiQ will help you navigate the complexities of TDG compliance to ensure you are getting the right waste to the right place.
Cross-Border Movement of Hazardous Waste and Recyclable Material Regulations
Environment and Climate Change Canada (ECCC) is responsible for administering and enforcing the Canadian Environmental Protection Act, 1999, and its regulations, including the XBR. XBR regulates the transportation of hazardous waste and recyclable materials across provincial and international borders to ensure that hazardous waste generated by industry is safely transported for treatment, recycling, and disposal.

WiQ assists generators when moving regulated materials across inter-provincial borders by ensuring the correct movement document is used and is completed in accordance with all applicable federal and provincial regulations.
Provincial Regulations
Alberta Energy Regulator
The Alberta Energy Regulator (AER) is mandated to provide for the efficient, safe, orderly, and environmentally responsible development of energy and mineral resources in the provides. AER's Directive 058: Oilfield Waste Management Requirements for the Upstream Petroleum Industry details the requirements for waste generators and receivers on the handling, treatment, and disposal of oilfield waste in a safe and responsible manner. WiQ has brought Directive 058 to life to help take the guess work out of waste coding and classification.
Alberta Environment and Parks in Alberta
Alberta Environment and Protected Areas (AEPA) protects the environment and natural resources by preserving the quality of water, air, natural lands, and wildlife in the province and is one of the responsible ministries for the Environmental Protection and Enhancement Act (EPEA). The Waste Control Regulation, enabled through EPEA, outlines the requirements and responsibilities of generators, carriers, and receivers for the transportation of industrial hazardous waste. The WCR references the Alberta User Guide for Waste Managers, which serves as a valuable resource for individuals and businesses involved in waste management activities within the province.

By following the guidelines outlined in the User Guide, you can ensure that you waste management practices are compliant with the regulations set by the Alberta Environment and Protected Areas (AEPA) and Transportation of Dangerous Goods (TDG). The AER also directs readers to the Alberta User Guide for Waste Managers where it is unclear if the waste classification is DOW or NON-DOW.
Saskatchewan Ministry of Energy and Resources
Saskatchewan's Ministry of Energy and Resources (MER) is responsible for the development, coordination, and implementation of policies and programs to promote the growth and responsible development of the natural resource industries within the province. Through the Oil and Gas Conservation Act and Regulations, the MER regulates the handling, transportation, and disposal of wastes produced at MER regulated facilities. In addition to the legislative requirements, the MER has published various Directives and Guidelines that outline the requirements for waste storage and drilling waste management. Once a waste material is removed from a MER regulated facility for transport and disposal, jurisdictional oversight transfers to the Ministry of Environment and hazardous wastes are subject to the associated transportation requirements.

Saskatchewan's Ministry of Environment (MOE) mandate is to provide science-based solutions to maintain compliance and ensure mitigation measures are in place for the protection of the environment, the safeguarding of communities and to help ensure balanced economic growth and a better quality of life for Saskatchewan residents.

The Environmental Management and Protection Act establishes the Hazardous Substances and Waste Dangerous Goods Regulations which dictates how hazardous wastes are managed within the province. The MOE has a variety of supplemental documents that assist generators by explaining the storage and transportation requirements for wastes and how those requirements are subjected to the various pieces of legislation in the province.
Ministry of Environment and Climate Change Strategy in British Columbia
The Ministry of Environment and Climate Change Strategy (MECC) is responsible for the protection, management, and conservation of the environment in B.C.

The Environmental Management Act (EMA) regulates industrial and hazardous waste in the province and enables the Hazardous Waste Regulation (HWR) which addresses the proper handling and disposal of hazardous wastes. The MECC has developed a guidance document for the HWR for use that explains each section of the regulation and how it applies to generators.

The British Columbia Energy Regulator (BCER) is the regulatory body in the province that is responsible for overseeing oil and gas operations, refineries, and geothermal developments in B.C. Through the Oil and Gas Waste Regulations, the BCER enables the EMA and HWR for oil and gas regulated facilities while expanding on the requirements set out in those regulations.

Receiver
What features are available to me?
Icon Rounded Chevron Dark - BRIX Templates

Receiver operations: at anytime, you are able to update your specific facility information including hours of operation, facility contact details, permit approval numbers, and AEPA documentation PINs. This can be modified to reflect closures of your facilities to your customers.

Manage substances: Receivers can customize an acceptable substances list for all facilities within their organizations. This gives you the ability to communicate to your customers what type of substances your facilities can and cannot accept. During the ticket creation process, receivers are selected by the generator from the drop down list. If a generator has selected a waste type that your facility cannot accept, the facility will not appear in the dropdown list.

Submit discrepancies: during the offload process, if there is a discrepancy between the manifest and the actual load that has arrived at site, receivers can submit discrepancies directly in the WiQ app. The discrepancy will go back to the receiver to review and approve.
